Falcory Terms of Service
1. Service
Falcory provides a daily data file for one county selected by the Customer ("Seat"), listing residential properties whose listing status changed to pending or sold on the previous day, with the property owner's name, property address and, where available, mailing address, telephone number and telephone screening flags. Falcory delivers the file by email to the address on the Customer's account, or to a shared folder the Customer designates. Falcory performs no calling, mailing, texting or other outreach on the Customer's behalf and gives no advice on how the file is used.
2. Evaluation sample
Before purchase Falcory may provide up to three consecutive daily files for the Customer's selected county. Sample files are licensed for internal evaluation only. The Customer may not resell, redistribute, share outside its own organisation or use sample data for any purpose other than deciding whether to purchase a Seat. On request, or at the end of the sample period if no purchase follows, the Customer will delete the sample files and confirm deletion in writing. Sample data is provided as is, without warranty.
3. Subscription, price and billing
A Seat costs a flat USD 997 per month, billed monthly in advance on the payment method the Customer selects at purchase. There is no per-lead, per-record or usage charge. The subscription is month to month and the Customer may cancel at any time for future months through the billing portal or by written notice; no refund is owed for a month already delivered except under clause 4. Falcory gives at least 30 days' written notice before any change to the price or to what a Seat covers.
4. First-month cancellation
A Customer purchasing a new Seat may cancel in writing within 14 days of the first data delivery under that Seat and receive a full refund of the first month's fee. Notice is effective on the date Falcory receives it at the contact address in clause 12.
5. County Seat limits
A Seat covers one county and every price point within it. Falcory limits each county to three active Seats, opened in the order purchased, and counts evaluation samples under clause 2 toward that limit, so that no more than three organisations receive a county's daily file at any time. A Customer holds at most one Seat per county. If Falcory sells a Seat beyond that limit in a county where the Customer's Seat is active, Falcory will refund that month's fee in full to the Customer as the Customer's sole remedy. This clause creates no right to a specific county and no guarantee of future availability once a county reaches its limit. Any later introduction of price brackets is a change to what a Seat covers under clause 3, and a Seat purchased under these terms keeps its full-county scope unless the Customer agrees otherwise.
6. Customer obligations and compliance
The Customer is solely responsible for its use of the data and for compliance with all laws that apply to that use, including the Telephone Consumer Protection Act, the Telemarketing Sales Rule, national and state do-not-call rules, CAN-SPAM and state privacy and consumer-protection laws. Falcory's telephone screening flags are provided to assist the Customer and do not replace the Customer's own compliance obligations. The Customer will not use the data to send text messages to any number in the file, to contact any person for purposes other than the Customer's own moving services, or in any way that is unlawful, deceptive or harassing.
7. Licence and restrictions
Falcory grants the Customer a non-exclusive, non-transferable licence to use the daily files internally for the Customer's own marketing of moving services during the subscription. The Customer may load the files into its own dialer, CRM and advertising accounts. The Customer may not resell, license, publish or otherwise distribute the data, combine it into a product for third parties, or use it to build or train a competing data service.
8. Data accuracy
The data is compiled from public listing sources and third-party data providers. Falcory does not warrant that any record is complete, current or accurate, or that any telephone number is reachable or lawful to call. The Customer verifies before relying on any record.
9. Retention and deletion
On termination of a Seat the Customer will stop using files delivered under it within 30 days, except records the Customer has lawfully incorporated into its own customer records. Falcory may require deletion of sample data under clause 2 at any time.
10. Limitation of liability
To the maximum extent permitted by law, Falcory's total liability arising out of the service in any twelve-month period is limited to the fees paid by the Customer in that period, and Falcory is not liable for indirect, incidental, special or consequential damages, lost profits or lost business. Nothing in these terms limits liability that cannot be limited by law.
11. Governing law
These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Disputes are brought in the state or federal courts located in Wyoming, and each party consents to their jurisdiction.
12. Notices and contact
Notices to Falcory go to the email address published on this page: leads@falcory.com. Notices to the Customer go to the email address on the Customer's account.
13. Changes
Falcory may update these terms with 30 days' notice by email. Continued use after the effective date of a change is acceptance; a Customer who does not accept may cancel under clause 3.
